Welcome to McClatchie Contracting. By accessing our website or engaging with our services, you agree to the following Terms and Conditions. These terms govern your use of our website and any estimates, communications, or services provided by McClatchie Contracting ("we," "our," or "us").
1. Use of Website
The content on this website is for general information about our services. We make reasonable efforts to ensure the information is accurate, but we do not guarantee completeness or suitability for specific purposes. We reserve the right to update content or policies without notice.
You may not misuse this website in any way, including by attempting unauthorized access, transmitting malware, or interfering with its functionality.
2. Estimates and Contracts
Any estimates provided through this site, via email, or in person are non-binding and subject to change after a full site visit and consultation. Final scope and pricing are confirmed only through a written contract signed by both parties.
In accordance with Ontario law, we follow the 10% cap on final billing compared to original estimates, unless approved by the client in writing via a change order.
Change orders must be signed by the client and will be invoiced after work is completed. Clients will receive a copy of all contractual documents via email.
3. Payments and Deposits
We require a standard 30% deposit to confirm project start. Remaining payments are due according to the schedule outlined in your contract. We accept payments in person or electronically via QuickBooks.
Deposits are non-refundable after the 10-day cooling-off period (required under Ontario’s Consumer Protection Act for in-home agreements). Refunds after this period are reviewed case by case.
4. Cooling-Off Period and Early Start
Under Ontario’s Consumer Protection Act, clients who sign a contract in their home are entitled to a 10-day cooling-off period during which they may cancel the agreement without penalty.
If a client requests that work begin before the 10-day period ends, this request must be made in writing. In such cases, if the client chooses to cancel during the cooling-off period, they may be required to pay for any work completed or materials provided up to the date of cancellation.
5. Project Scheduling and Delays
We strive to complete all projects on schedule. However, timelines may be affected by factors beyond our control, including weather conditions, supply chain disruptions, or client-driven changes.
In such cases, we will communicate promptly and adjust schedules in good faith. Project timelines outlined in contracts are targets, not guarantees.
6. Intellectual Property
All text, graphics, logos, and images on this site are the property of McClatchie Contracting. You may not copy, reproduce, or use this material without our written permission, except for personal reference.
7. Limitation of Liability
We are not liable for any damages arising from the use of our website or reliance on its content. We are not responsible for loss, delays, or additional costs caused by third-party services or unforeseen conditions.
Our liability for services rendered is limited to the terms specified in your signed service contract.
